Separation and Divorce
There is much confusion in this area. The common term "divorce"' is now called "dissolution". A dissolution order from the Family Court legally ends a marriage. You need to have lived apart from your spouse for a period of 2 years.
Dissolution of a current marriage is a necessary step before a person can legally marry again.
The Court will usually decline to make a dissolution order if it appears that relationship property has not been finally divided or care and support arrangements for children are uncertain.
We encourage our clients to file the dissolution application themselves to save avoidable legal costs. Your local Family Court office can help you or if you prefer, we can recommend someone who will be able to assist. You are welcome to seek an interview to determine your rights should you be thinking of leaving your spouse or partner.
