Rights of Grandparents

QUESTION:

I am wondering as grandparents if we have rights under the Care of Children’s Act 2004.

ANSWER:

Thank you for your email. What your situation is depends on where you are in this dispute. If your daughter lives with you, then It is probably best to support her case if all is well with her situation. You should see a lawyer about this to see what your position is and whether you should you support your daughter or make your own application as grandparents?.

You do have rights under the Care of Children Act, but your rights are subject to the welfare and best interests of the child.

I am happy to help you and you may qualify for legal aid, meaning some or all of your fees are paid for by the Legal Services Agency.
