Lawyer for Child and Bill of Rights
Q: The lawyer for child is due to see my son soon. He is only 2 years old. I want to be with my son all the time as he is very shy. Do I have a right to be present all the time in the interview? What is the normal practice? What rights do I have?
A: It is normal for the lawyer to see the child with the parent and on their own. The child will normally be more forthcoming if left on their own. The Judge may pay less weight to the lawyer for child report if the parent is present.
Your rights are subject to the best interests and welfare of the child.
You need to work this through with your own lawyer.
