Hague convention and Relocation from NZ

Q: What is the relationship between the Hague convention and relocation from NZ to another country?

A: As you will see elsewhere in my site and blog, the aims of the Hague Convention include to rectify the wrongful removal of a child from their habitual (usual) place of residence.  In general it is hard  for a parent who has moved to another country from NZ to  successfully defend a Hague Convention application.

A relocation application from NZ depends on its facts; and is the right legal thing to do if you plan to move out of NZ or to another city with your child.

If you make a successful relocation application, say from NZ, then you have permission to leave NZ with your child and you have your legal rights covered. The other party cannot normally apply under the Hague Convention as you have been allowed to leave.
